Terms and Conditions
If you are a registered user of www.livemusicquotes.com and have supplied your email address, Live Music Quotes may occasionally send you an email to tell you about new features, solicit your feedback, or to keep you up to date with what’s going on with Live Music Quotes and our products. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Live Music Quotes takes all measures reasonably necessary to protect against unauthorised access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.
Authority to sign
The person signing this contract on behalf of the Client or Musician/s must have authority to bind the Client or Musician/s in such a contract, and if they do not have such authority they will be personally liable for any fees payable under these Terms and Conditions.
To create an event listing, the Client will be asked a variety of questions about the event to be listed, including, but not limited to, the date and time, the location and the services required. Auction listings will be made publicly available on LMQ hub for musician only to apply and send quotes. Accordingly the Client is responsible for the information / details of the Event provided and must notify both Live Music Quotes and the Musician/s or any changes to the event in good time.
Please note that Live Music Quotes assumes no responsibility for a Client’s compliance with any agreements with or duties to third parties, applicable laws, rules and regulations.
Please note Live Music Quotes reserves the right to cancel and/ or remove any events and disable access to the website without prior notice.
All payments are subject to VAT and will be added to the final invoice.
a) Auction service: When the Client chooses the Musician/s to perform at their event and their quote, the client will be required to pay the full price plus a variable commission via Paypal or valid card payment over the phone.
b) Book Now: When the Client books their chosen musician/s, payment will be required at the time of booking, in order to secure the Musician/s for their event.
c) Managed service: all final payments must be finalised and issued to Live Music Quote only. Payment must be made at least 3 days before the event.
If you cancel this Agreement within the cancellation period, we will reimburse to you all payments received from you according to the time scale.
In the event that the Musician/s notifies you of cancellation less than 48 hours before your Event, we shall use our best efforts to find a replacement Act that is acceptable to you and available for your Event. If we are unable offer a suitable replacement, and provided that your Order was submitted more than seven days prior to your Event, we shall offer a full reimbursement.
All cancellations must be made in writing and will be subject to the following terms and time scale in order to qualify for the reimbursements:
a) If the Client cancels the Booking within the cancellation period (30 days before the date of event) we will reimburse to you all payments the Booking event received.
b) If the Client cancels the Booking within 14 days, only the deposit will be reimbursed to the client.
c) If the Client cancels the event within 7 days prior to the event, no payment will be reimbursed.
Cancellation by the Musician/s is not permitted by Live Music Quotes, however exceptions will be made if the cancellation is due to extreme unforeseen circumstances.
In the event that the Musician/s cancels the Client’s Booking within the cancellation period (14 days) we will notify the Client and find an alternative Musician/s for the same booked fee.
Public Liability and Equipment Safety
The Musician/s and Venue accepts full responsibility for maintaining their own public liability insurance (minimum of £1 million) and equipment safety documentation including P.A.T. testing certificates for all electrical equipment used at the event.
The Client must ensure that all necessary licenses and permissions for the event are in place including relevant and up to date Public Liability Insurance and the client must inform the musician of any Noise Limiter and/ or restrictions placed by the venue. If the client fails to comply with the venue, resulting in the musician not being able to perform, then the client will be liable for the total fees.
a) The Musician/s will provide a highly professional level of performance and shall behave in a professional manner at all times during their time in attendance at the event.
b) The Musician/s shall communicate with the Client immediately in the event of any issues relating to their performance at the event.
c) The Musician/s warrants that all equipment is in good working order, and fit for its purpose, and that no part of the performance is likely to be a danger to the artiste/s or any other person/s.
d) The Musician/s at the time of signing this contract shall not be under any contract to a third party that might preclude him/her from fulfilling the engagement.
e) Musician/s shall be suitably and tidily dressed during their performance. The wearing of jeans and trainers are strictly forbidden except with the consent of the client or where the wearing of such attire is deemed to be a necessary part of their act.
f) The Musician is responsible for their own TAX & N.I. Contributions.
g) The Musician/s agrees that whilst with LMQ any further engagements offered, whether from the client from a previous contracted event or any other client or potential client, shall be negotiated through LMQ management. Failure to adhere to this will result in the Musician/s incuring a penalty fee and being invoiced accordingly.
a ) The client must ensure that the venue provides PA, staging and backline for the musicians. If this is not possible then additional charges will be invoiced to the client in order for LMQ to supply the relevant equipment.
b) The client is to notify us via email or phone call of any specific requirements and instructions before booking a musician to make sure that the Musician is capable/suitable for the event.
c) The client is to co-operate with Live Music Quotes in relation to the Event booking from signing to execution of the event. The adjustment of the volume and sound level of any equipment shall be as the client reasonably requires.
d) The client agrees that any further engagements offered as a result of this engagement shall be negotiated through the management, and not the artiste/s. Failure to adhere to this could result in the client being invoiced accordingly.
e) The client shall be responsible for the provision of mains electricity in the performing area.
f) The client agrees to keep all Musician equipment secured and safe in their premises during the Event and afterwards, should the musician and Client arrange for the equipment to be left overnight.
A binding contract is issued with the Client when the Client approves the musician they want to perform at their Event either via our Auction Service and/ or Managed Service.
The Client understands and agrees that once a Musician places a quote for their Event, the Client may not request the Musician to accept a lower fee than in the booking request.
The Client acknowledges and agrees that they alone are responsible for any and all Event listings and Member Content they post.
Client and Musician communication must be contained and maintained within the Live Music Quote messaging system or between LMQ management. All musician bookings must be confirmed and paid via the LMQ website.
A repeat booking of the same and/ or musician must only be booked via LMQ booking system and no external negotiations will be permitted and in the event that this happens, the Client will incur a penalty fee from LMQ for not complying with the Terms and Conditions.
